In the event that the staff appointed to a new category (i.e. from AS to NS, or from NS to IS) is rated at 2 or lower in the first two performance reviews after appointment at the new level, they will return to the level occupied immediately prior to their appointment in the new category.

The position is assigned within Office of the General Counsel (OGC). OGC is responsible in protecting the legal interests of ADB and advises on methods to limit ADB’s risk exposure appropriately. It prepares or reviews documents which create, define, modify or limit the legal rights or obligations of ADB, including loan contracts, agreements and registration statements in relation thereto, and other contractual documents.

Job Purpose

The Senior Legal Officer (Institutional and Administrative Law) will support the functions of the Office of the General Counsel (OGC) by providing legal advice on institutional and administrative matters, and other operational and advisory work as required. The incumbent will report to the Assistant General Counsel and/or designated International Staff and may supervise Administrative staff .

Responsibilities

Institutional and Administrative Matters:

Provides support on institutional and administrative matters, including:

· ADB’s Personnel policies, Administrative Orders, and issues including pension administration, staff benefits, staff grievances, disciplinary procedures;

· Employment disputes, including pre-litigation matters and assisting the assigned counsel in proceedings before the Appeals Committee and ADB’s Administrative Tribunal;

· Administrative law matters affecting ADB Headquarters, Resident Missions and Representative Offices in ADB member countries, such as leases, relevant aspects of ADB’s host country agreements, and institutional procurement questions;

· Data privacy and data protection policies, and legal aspects of the management of ADB’s information technology systems;

· Privileges and immunities of ADB and its personnel in member countries, as set forth in the ADB Charter and in host country agreements;

· Issues arising with ADB’s membership, and decision-making organs;

· Implementation of treaties and other agreements concluded by ADB on institutional matters;

· Reviewing local laws and regulations applicable to specified matters; and

· Preparing documentation for any of the above matters.

Legal Research and Support

· Conducts research on legal and policy matters.

· Carries out research work on legal precedents of the ADB Administrative Tribunal, and administrative tribunals of other relevant organizations. Maintains an index and summaries of relevant case law.

· Carries out research work on developments at the national level which is of relevance to the organization.

Others

· Performs other duties that may be assigned.

· Undertakes special projects in support of OGC’s operations generally.

Qualifications

Relevant Experience & Requirements

· Bachelor’s degree in Law and member of the Philippine Bar, or its equivalent work experience in a multilateral financial institution, and preferably with advanced training.

· Minimum of 8 years of relevant professional experience, with in-depth knowledge of institutional and administrative law.

· Able to communicate, present and defend complex legal arguments and issues.

· Able to work in multi-cultural and multi-skilled teams.

· Able to inspire trust and confidence and promote a strong culture of honesty, trust and openness.

· Excellent written and verbal communication skills in English is required

General Considerations

The selected candidate, if new to ADB, is appointed for an initial term of 3 years.
